The EU Visa Code sets it in Article 5. You apply to your main destination. That is the country where you spend the most nights, or the main reason for your trip. If there is no main destination, you apply to the country you enter first. You can’t choose a country for better odds.
How does the rule work on a real trip?
Count your nights in each country. The country with the most nights is your main destination, unless the main reason for your trip is somewhere else.
- 5 nights in France, then 3 in Italy: you apply to France. It has the most nights.
- 4 nights in Germany and 4 in Austria, landing in Germany: no country has more nights. You apply to Germany, where you enter first.
- The same trip for a work meeting in Vienna: Austria is the main reason for the trip. It can be your main destination.
- Most nights in Liechtenstein: you apply through Switzerland, which issues Liechtenstein’s visas in India.
Do refusal rates change where I apply?
No. Refusal rates are past averages. They play no part in which country handles your file. Apply to a country that is not your main destination, and it can send your file back. It will tell you where to apply.

Questions people ask
Is it the first entry or the longest stay?
The longest stay, in most cases. Your nights decide your main destination. The first entry only counts when there is no main destination, for example when your nights are equal.
Can I apply to the country with the lowest refusal rate?
No. Article 5 of the EU Visa Code decides which country handles your visa. Refusal rates play no part in it.
